Was verbindet Admir Sinamat mit der „Gërdec“-Tragödie? Admir Sinamati wurde oft beschuldigt, die Akte von Kosta Trebicka manipuliert zu haben, dem Geschäftsmann, der am 12. September 2008 unter mysteriösen Umständen tot auf einem Feld oberhalb von Voskopoja aufgefunden wurde. Er war Gërdecs Kronzeuge. Zuvor hatte Kosta Trebicka Shkëlzen Berisha, dem Sohn von Sali Berisha, offen gedroht, dass er über die Wahrheit über das Geschäft in Gërdec sprechen würde, wo 26 unschuldige Menschen nach der Explosion ihr Leben verloren. David Packouz, der Partner von Ephraim Diverol, mit dem er den 300-Millionen-Dollar-Deal vom Pentagon gewann, um Munition aus Albanien zu sichern, hat kürzlich die Intrigen, Vereinbarungen und Korruption gestanden, bei denen Diveroli damals mit albanischen Spitzenbeamten zu tun hatte.
In einem Interview mit dem Podcast „Concrete“ hat Packouz gestanden, wie Diveroli es geschafft hat, mit dem Sohn des ehemaligen Premierministers Sali Berisha über die Senkung des Preises für chinesische Feuerwerkskörper zu verhandeln, während er sich ausführlich an die Gespräche von Costa Trebicka und Star Pinari erinnert.
David Packouz von der Firma „AEY“ erinnert sich, wie sie mit Costa Trebicka Vereinbarungen über das Umpacken von Munition getroffen haben, wobei chinesische Schilder verschwinden gelassen wurden, weil befürchtet wurde, dass Munition chinesischen Ursprungs einem Embargo aus den USA unterliegt.
„Ephraim traf die Entscheidung, dass er nicht das Risiko eingehen wollte, einen 300-Millionen-Dollar-Vertrag zu verlieren, also anstatt es der US-Armee zu sagen und das Risiko zu akzeptieren, dass sie seinen Vertrag kündigen könnten, beschloss er, jemanden zu bitten, die Munition neu zu packen. Entfernen Sie es aus Kartons mit chinesischen Zeichen und legen Sie sie in Plastiktüten und dann in Kartons. Wir wollten das eigentlich tun, bevor wir herausfanden, dass die Munition chinesisch war. Denn zu dieser Zeit waren die Treibstoffpreise gestiegen und der Luftverkehr war sehr knapp. Also dachten wir, die Munition sei in schwere Holzkisten verpackt, und wenn wir sie abnehmen würden, würden wir das Gewicht stark senken und mehr Munition schicken, im Gegenzug würden wir mehr verdienen.
Um dies zu tun, ging mein Freund Alex nach Albanien und fand einen Kartonhersteller und stellte ihn ein. Dort stellten wir fest, dass es sich um chinesische Munition handelte, nachdem wir beschlossen hatten, sie neu zu verpacken. Dann sagten wir: „Wir müssen es sowieso neu verpacken, aber wir müssen sicherstellen, dass wir auch die chinesischen Schilder entfernen.“ Wir waren sehr dumm und haben das per E-Mail gemailt, was großartige Tracking-Möglichkeiten hinterließ“, sagt David Packouz.
Er erinnert sich weiter, wie Patrick Henry von der Firma „Albademil“ ihm 1 chinesische Kugel für 2 Cent kaufte und sie für 4 Cent verkaufte. Dies erregte den Zorn von Ephraim Diverol, der versuchte, Henry aus dem Spiel zu holen, indem er direkte Vereinbarungen mit den Albanern traf. Aber Henry, so Packouz, war ein guter Freund der Oblast.
„Wir haben viel Geld für den Lufttransport gespart. Ich glaube, wir haben 100.200 Dollar bezahlt, oder 7.62 Dollar, ich erinnere mich nicht gut daran, für all das Umpacken in der Tota. Die Person, die wir für das Umpacken eingestellt haben, war der Besitzer einer Firma, die Kartons herstellte, also da er die Fabrik und die Arbeiter hatte, warum bekommen wir es nicht? Sein Name war Costa Trebicka. Er war glücklich, den Job zu machen, aber was passierte, war, dass Ephraim mehr Geld verdienen wollte. Er wollte immer mehr und bat die Albaner, den Preis zu senken, fragte ihn durch Henry, weil er den Deal für uns gemacht hatte. Er sagte: „Ich will einen besseren Preis“, und Henry sagte: „Ich kann den Preis nicht ändern.“ Ephraim fliegt nach Albanien und beginnt mit Costa zu sprechen, und Costa sagt: „Ich habe einen Freund im Verteidigungsministerium, ich kann Ihnen einige Informationen geben.“ Und Costa erfährt, dass das Justizministerium die Munition für 39,2×4 mm offiziell für 10 Cent pro Stück an Henry verkauft. Und Henry verkaufte uns für vier Cent. Das verärgerte Ephraim. Wir verkauften es für 5,3 Cent an die US-Regierung, aber wir mussten auch für den Transport bezahlen, was 4 oder <> Cent pro Runde war, von dem wir dachten, wir wären bereit für das, was Henry getan hat „, sagt Packouz.
An einer Stelle während des Interviews erzählt Packouz auch die Anklage gegen Salzen Berisha, der behauptete, dass das Geständnis in dem Buch „Weapons and Chums“ über sein Treffen mit Diverolin unwahr sei. Das Gericht in den USA entschied, den Fall trotzdem abzuweisen. Packouz spricht Berisha während des Interviews sogar an und sagt: „Verklagen Sie mich nicht noch einmal“.
„Wir waren sicher, dass Henry dort einige Politiker bezahlte. Nachdem er sehr mit dem Sohn des Premierministers befreundet war, wurde Sali Berisha Premierminister. Der Junge (Salvini) beschloss, mich zu verklagen, und Ephraim wurde wegen Verleumdung aus dem Saal gebracht, damit Herr Berisha mich nicht noch einmal verklagen würde. Zum Glück für mich wurde er aus dem Gericht genommen, er war unbegründet. Aber Simon verlor das gesamte Geld, das aus dem Buch extrahiert wurde, da er alle Kosten decken musste. Heinrich hatte eine enge Beziehung zum Sohn des Premierministers und erhielt so Zugang zu Munition. Wir vermuten, dass er Leute bezahlte und nicht alle 2 Cent für sich behielt. Aber Ephraim konnte nicht glauben, dass Henry uns erpresste, und er wollte ihn aus dem Geschäft herausholen. Also sagte er: „Ich werde Henry aus dem Deal herausholen, ich werde meinen eigenen Deal mit den Albanern machen“, sagt Packouz.
Packouz gesteht ferner Ephraim Diverols Treffen mit Sali Berisha in Anwesenheit von Star Pinari und einer großen albanischen Mafia, bei dem entschieden wurde, dass Costa Trebicka, der die Verpackung durchführte, aus dem Spiel genommen wurde, die Umverpackung würde sie nehmen und ihm im Gegenzug eine kleine Reduzierung des Kaufpreises für Munition geben.
Er sagt, Costa Trebicka sei wütend gewesen, nachdem er herausgenommen worden war, und beschloss, die Medien und Behörden in den USA zu kontaktieren, die die Ermittlungen eingeleitet hatten. Costas größter Fehler, sagt Packouz, war, dass er auch albanische Medien kontaktierte, wo er Korruption aufdeckte. Dies, so Packouz, kostete Costa Trebicka das Leben.
„Ephraim i geht nach Albanien und trifft sich mit Pinar, war von der albanischen Exportorganisation. Ein staatliches Unternehmen, das damit beauftragt war, jede Art von Munition zu verkaufen, die die Regierung verkaufen wollte. Er traf Pinar, dieses Treffen steht auch im Buch, und dafür verklagte er uns, Herrn Berisha (Salvini). Er traf Pinar und den Sohn des Premierministers und eine andere Person, die ein albanischer Gangster war. Ich erinnere mich nicht an seinen Namen.
Ephraim erkannte, mit wem er es zu tun hatte, er redete normalerweise viel, Alex war da und erzählte mir, dass er, sobald er dort ankam, sofort seine Stimme senkte. Sie sagten ihm, schau, wir werden dir keinen besseren Preis geben, das ist der beste Preis in Europa. Wir wissen jedoch, dass Sie das Umpacken vornehmen, und Sie haben diesen Typen eingestellt, der nicht Teil unserer Organisation ist, und Sie zahlen ihm eine Menge Geld. Wenn Sie es loswerden und uns für die Verpackung bezahlen, machen wir Ihnen eine Landung. Und Ephraim sagt „Deal“. Ich nehme Costa aus dem Deal und Costa empörte sich sehr, dass er noch 20.<> Dollar übrig hatte, er bezahlte ihn nicht. Costa war sehr wütend, weil er wusste, was los war, wir hatten ihm vorsichtig gesagt, dass es keine chinesischen Schilder gab, und er geht und erzählt es der New York Times und amerikanischen Beamten. Und sie begannen mit der Untersuchung. Aber sein größter Fehler war, dass er die albanische Presse kontaktierte und ihm gesagt wurde, dass es mit diesem Abkommen große Korruption gibt, dass Politiker Bestechungsgelder annehmen. Er endete tot in mysteriöser Rethana. Einen Monat später war er alleine auf einer ebenen Straße unterwegs und erlitt plötzlich einen Unfall, bei dem er einige Meter vom Auto entfernt landete. Sie nannten es einen Unfall, aber es war ein sehr seltsamer Unfall“, sagt Packouz in seinem Geständnis.
US Ambassador Donald Lu asked former General Prosecutor Adriatik Llalla to stop a criminal investigation of Bankers Petroleum for an explosion which damaged about 200 houses in Patos-Marinëz, Fier in 2015.
Yesterday, the online media outlet Hashtag.al published an email that Ambassador Lu sent, on July 24, 2015, to the then General Prosecutor Adriatik Llalla. Ambassador’s email, written in Albanian, reads:
I can’t stress it enough how concerned I am personally for the consequences of the criminal investigation against the Bankers Petroleum employees by the Fier Prosecution Office. In any other country we would expect to see fines and administrative penalties. Criminal charges are unusual.
This will have a major impact on the capability of Albania to attract foreign investments – exactly at a time when Minister [of Industry and Energy] Gjiknuri is trying to seek foreign investors to participate in the auctioning of [onshore] oil blocks in Albania. I will be sincere with you, it is my suspicion that corruption or political pressure might have influenced the decision of the Fier Prosecution Office.
We will be following this matter closely.
This email followed a formal letter, on behalf of the US Government, sent a day earlier to Llalla by the ambassador, which was made public, two years ago, by the daily newspaper Dita. Using, of course, a more careful wording than in the email, Ambassador Lu asked Llalla to end the investigation on Bankers Petroleum. It is also now known that, around the same period, Ambassador Lu visited General Prosecutor Llalla’s office, together with Bankers CEO David French, again asking the prosecutor to drop the criminal charges against Bankers.
Bankers Petroleum, the largest company in Albania, is an offshore incorporated and Canada-based oil company, which has the exclusive exploration and extraction rights in the Patos-Marinëz area. In 2017, the company was bought by a Chinese company.
The investigation in question focused on several explosions at Bankers drilling sites in Marinëz, which happened on 2 April 2015, damaging around 200 houses in the nearby village of Zharrëz. At least one of the explosions occurred during efforts to reactivate an idle well without any proper permission to do so. The Fier Prosecution Office opened a criminal investigation on “destruction of property due to negligence” and “air pollution.”
It is unclear why the US Ambassador involved himself on this matter – he has never publicly commented on it – given the fact that Bankers is not a US company and is unrelated to any known US interests. Nevertheless, it is now clear that Ambassador Lu attempted several times to force former General Prosecutor Llalla to stop the investigation.
The email published by Hashtag.al raises renewed doubts on Ambassador Lu’s judgment and integrity.
Not only does Ambassador Lu ask former General Prosecutor Llalla to drop any criminal indictment of Bankers, but he also seems to suggest the course of action prosecutors should take and the sentence they should ask. He, furthermore, politicizes the investigation by suggesting that Llalla’s actions would have a negative influence on the efforts of the Rama government to attract foreign investments. Lu implies that Llalla and the prosecutors in Fier should not decide the case based on facts and the Albanian law, but in such a way that would serve the government.
It is obvious that Ambassador Lu’s email might constitute an attempt to obstruct justice by unduly influencing a criminal investigation. In the US such action is considered a serious crime; the federal US code has 21 statutes related to all different actions constituting obstruction of justice. One of these statutes, 18 U.S. Code § 1512 relates to efforts by someone who “obstructs, influences, or impedes any official proceeding, or attempts to do so.” Under this statute a person found guilty of obstruction of justice shall be fined or imprisoned up to 20 years.
Just to put Lu’s case in context: President Trump is being currently investigated by the Special Prosecutor Robert Mueller on a case that pales in comparison with Lu’s direct insistence and threats to Llalla to stop an official investigation.
Moreover, Ambassador Lu’s actions openly interfere with the domestic affairs of Albania, which is a violation of the Vienna Convention on Diplomatic Relations.
While Ambassador Lu is protected by diplomatic immunity and cannot be held accountable for his violations of the Albanian law, the moral and ethical consequences of his actions cannot be underestimated. His continuous, blatant involvement in several ongoing investigations in Albania is a travesty of the principles of rule of law and the separation of powers, which have been the hallmarks of the government he represents.
Unfortunately, Ambassador Lu has attributed many of his dubious actions to the US government. In this email, as in other cases in which Lu tried to impose himself into official proceedings, Lu uses the plural “we,” implying “we the US Government.”
It is difficult to imagine that it was in the interest of the US government to intervene directly into the Bankers case; it is a foreign company, registered offshore, owned by a Chinese company, which allegedly evades taxes and carelessly damages private properties and pollutes the environment in Albania. It is more therefore more likely that Ambassador Lu has used and abused the name of the US Government on a matter that was of private interest to him.
In fact, Ambassador Lu suggests as much. In the email he states that his concern, which he “could not express enough,” was “personal.” The reason why he was personally concerned remains a matter of speculation, but the question is how an ambassador is allowed to abuse his position and the name of the US Government to protect private interests.
The email also reveals Ambassador Lu’s now familiar approach of unwarranted accusations of corruption and political interference. In the email, Ambassador Lu states that he suspects “corruption or political pressure might have influenced the decision of the Fier Prosecution Office.”
But why does he have these suspicions? We do not know. In fact, a criminal investigation for “negligence” causing an accident that has damaged property and the environment sounds like the right thing to do. It is also unclear who the Ambassador thought might have politically influenced prosecutors, given that the 200 poor families of Zharrëz do not have any political leverage or economic power, as they live on less than $5 a day.
What we do know now is that Ambassador Lu used accusations of corruption and political influence against those that did not bend to his will. Only a few months after the email, Ambassador Lu started attacking Llalla, when he did not drop the investigation, calling him an enemy of the justice reform and, later, a corrupt prosecutor.
The case of political influence by prosecutors was furthermore used by Ambassador Lu to defend former Minister of Interior Saimir Tahiri, one of the closest collaborators of Ambassador’s Lu until he was suspected and investigated in both Italy and Albania for aiding and abetting drug trafficking and membership of a criminal organization. In all the three public comments that Ambassador Lu has been forced to make about Tahiri he has been careful to imply or directly refer to possible political interference in his investigation.

In early 2007, after winning a $300 million U.S. Army contract to equip Afghanistan with munitions, Miami Beach arms dealer Efraim Diveroli, age 21, went scavenging in Albania. There he subcontracted Ylli Pinari, head of that Balkan country’s state-run arms agency, to fill the order from derelict stockpiles.
Pinari and Diveroli partnered to ship the order to Afghanistan. After U.S. authorities looked into the deal — which was illegal because the weapons came from China — they arrested Diveroli, who pleaded guilty last fall to illegal arms sales. He awaits sentencing (why, for what reason is this punk not in prison?). Now a press report, interviews, and documents obtained by New Times indicate the Miami Beach youngster might have been involved in an underworld of terrorism.
It all began March 15, 2008, when an Albanian stockpile exploded, rattling windows in neighboring countries and destroying a village. According to newspapers in the Balkans, Pinari was charged with mass murder over the blast. This past November 30, 2009, a dissident newspaper in Albania, Gazeta Tema, alleged Pinari had sold surface-to-air missiles to Hezbollah around the time he became Diveroli’s point man.
Indeed, in secretly recorded cell phone conversations described in the New York Times, Diveroli had said of Pinari: „either he’s the mafia or the mafia is controlling him.“ He claimed the mafia „went up higher to [Albania’s] prime minister [Sali Berisha],“ but explained, „I have to deal with [Pinari]. The U.S. government is expecting the products.“

US arms dealer Efraim Diveroli pleads guilty in Afghan weapons case, U.S. government dropped 84 other counts; MIAMI, Aug 31, 2009 (Reuters) – A U.S. arms dealer who illegally supplied Chinese-made ammunition to Afghanistan under a Pentagon contract pleaded guilty to a single conspiracy charge and the U.S. government dropped 84 other counts, court documents said. Efraim Diveroli, 23, of Miami Beach, Florida, faces up to five years in prison and a $250,000 fine on the charge of conspiring to defraud the United States and make false statements.
Sentencing was scheduled for Nov. 10. Diveroli’s Miami Beach-based company, AEY Inc, held a $298 million Pentagon contract to supply munitions to the Afghan government. The contract barred the company from shipping ammunition acquired directly or indirectly from a „Communist Chinese military company.“ Diveroli admitted in a plea deal signed in June that he bought ammunition made in Chinese factories between 1958 and 1974 from a military export company in Albania, according to the plea agreement filed in U.S. District Court in Miami.
Diveroli and his associates knew the ammunition would violate AEY’s agreement with the Pentagon so they removed it from wooden crates and metal tins bearing Chinese markings and repacked it in cardboard boxes, the plea agreement said. AEY delivered 90 million rounds of Chinese-made ammunition, Diveroli falsely certified that it conformed to terms of his contract and the Army paid $10.3 million into AEY accounts, the agreement said. The Pentagon said last year it had suspended AEY from all federal contracting work.
At the time a Pentagon spokesman said there had been no reports of safety problems with the decades-old ammunition but that could have been because it might not have been distributed to soldiers because of its condition. Oct. 8th 2008, The investigation into the death of a whistle-blower Kosta Trebicka in Albania appears to be nearing its conclusion, but with little hope of quelling the suspicion and speculation surrounding the case.
Kosta Trebicka, a witness in an inquiry, died (possibly murdered) on 9/12/2008. The whistle-blower, Kosta Trebicka, uncovered evidence of public corruption in the export of ammunition from the Communist era in Albania . His accusations were followed by arrests in Albania and charges against the employees of an arms-dealing company (AEY Inc) in Miami Fl, United States run by EFRAIM EZRA DIVEROLI, but only after an explosion at a munitions facility in the town of Gerdeci Albania killed 26 people, including children.
Mr. Trebicka, 48, a witness in the investigation into the explosion, a national tragedy in Albania, was found dead on a rural roadside near his car (see video click here). According to „News 24 TV“ Albania , Trebicka was linked with the American intelligence service CIA about the investigation of trafficking weapons by the Albanian army and Albanian mafia and he was the top person who knew everything about the Gerdeci Blast scandal of Albania last March 2008.
Albania’s government said on Friday Sept 12 2008 it was looking into the sudden death of an arms industry figure who was helping prosecutors investigate a weapons sale to the United States and an explosion that killed 26 people. Television pictures (see video click here) showed businessman Kosta Trebicka, his head covered in blood, sprawled on his back on a dirt road in a remote area of eastern Albania, where he had been hunting. His off-road car was nearby, and appeared to be damaged. Trebicka was involved in repackaging ageing Chinese ammunition that was being sold from Albania to AEY Inc (Efraim Diveroli), a U.S. firm contracted by the Pentagon to supply the Afghan army.
